They were smoking weed. The difference is if they had smoked all the weed they had, then it is just residue. If they still had some left, then it is possession of a controlled substance.

The reports I've read have said "bag of marijuana." They're either misleading reports or this "residue" thing is a load of shite.

No.

That only applies in Orleans Parish, not the rest of the state. And THEN it only applies if you are picked up by the NOPD, and not a sheriff's deputy.

shite gets complicated when the laws haven't all caught up to one another, but there's one thing to remember:

Cannabis is still ILLEGAL in ALL 50 states.

To the judge, the difference between the two would probably make a big difference. So it is hard to determine until it is confirmed.

I agree it's weird as frick but there isn't a whole lot of options here. The statute is pretty clear, if you are in possession of marijuana and a gun it's a 5-10 felony. No "if it's less than 30 grams" or anything, just 5-10. Some statutes allow the charge to be either a felony or misdemeanor depending on circumstances, but as it's written this isn't one of them.

I spoke to my neighbor about this case. He is an assistant district attorney. He said more than likely the drug charges and stolen weapon charge (provided he gives a reasonable answer to where the gun came from) will be dropped. That leaves possession of a firearm by a minor. If the two have clean backgrounds they will get a fine and probation.

what kind of fricking environment are these guys in that football players, albeit big and dumb, find the need to arm themselves to go to the park and burn one? It must be a free fire zone . I go to the drag races in West Monroe, actually south of there, and never see anything happening there requiring a firearm. I may be wrong but this may fall under mandatory jail time.

Wow, really? That would be quite a drop from felony jail time to probation and a fine.

I really wouldn't find that to be out of the ordinary for a first-time, non-violent offense. As long as he didn't personally steal the gun and thought he had a legal gun, they will probably plead him down and that wouldn't surprise me in the least.

Residue could mean field testing came up positive. Cops carry kits that allow them to see if something is an illegal drug. It's not an official result that can be used in court, but it's good enough for an arrest. The cop can't definitively say that bag of green stuff is weed until it's been lab tested, but he can say that it contains marijuana residue.

Technically in Louisiana this is true. At 18 years old, you can purchase a handgun in private sale. i.e. from another person. The handgun can also be legally gifted to someone by a parent or guardian if that person is atleast 18 years of age. This is the handgun loop hole.

They didn't, as the charge is clearly on their report.

The DA waits for the lab tests for the arraignment to make sure that the charges he's bringing are correct.

Ok, I took the post to mean that was a state law change.

So the question as to why that charge isn't listed as a felony is still unanswered.

And again, they absolutely committed crimes. That isn't in question at all.
