That's what I'm wondering, if the capital murder charge may be a reach. If it was a heat-of-the-moment thing, it might get reduced to murder. Doesn't capital murder have to occur during the commission of an underlying felony?

I'd laugh a little if it came out that Harvey Updyke was harboring the shooter the last couple days.
Glad the guy did at least one right thing and turned himself in and didn't go out in a blaze of glory hurting more innocents.
