Being drunk is not a legal defense to claim incapacitation. Therefore, if both parties were drunk and consented to it, even while being drunk, its not rape. even if one or both regretted giving that consent the night before. That's the issue a lot of times. If a girl says no, then that's about as clear as you can get. If she/he say yes, but the knowledge of the consent is lost in the hangover, you got evidentiary problems, and lives can be screwed over.
