Stolen gun taken across state lines

Knowledge of it being stolen is the burden of proof on the state. This will get plead down to a misdemeanor, probation, yada yada. He will sit a few games.

It's shady and sucks, but that's what will happen.

Yep, it's the state's burden.

To obtain a conviction for illegal possession of a stolen firearm, the State has to prove that the defendant intentionally possessed the firearm, that it was the subject of a robbery or theft, and that the defendant knew or should have known that the firearm was the subject of a robbery or theft. State v. Powe, App. 4 Cir.2014, 145 So.3d 583, 2014-0137 (La.App. 4 Cir. 7/16/14).
