Sure it is legally possible. If you drink over the limit you are drunk. If you don't fail a breath test then you are not waxed. Get it? I can drink 2 beers and pass all day. Is that too complicated for you?

If he had 2 beers he would have said 2 beers. A couple of drinks probably means 3-4 mixed drinks that means he was over the .08 limit. Was he too drunk to drive straight and stay on the road, probably not. But if you are arguing that the had a couple (2) of beers and wasn't over the limit then
. It was inconclusive because the cop didn't want to be a dick to Dak.
