Sure it is legally possible. If you drink over the limit you are drunk. If you don't fail a breath test then you are not waxed. Get it? I can drink 2 beers and pass all day. Is that too complicated for you?

actually it is. Legally intoxicated (drunk) does not mean you didn't have anything to drink
