Killing someone judged guilty by a jury of their peers after hearing evidence and having a vigorous defense is far from "murder."

Murder is a legal term defined as the unlawful taking of human life, if the death penalty is legal it by definition cannot be called murder. It's the same reason why calling abortion and hunting "murder" is simply wrong.
