He wasn't under arrest at that time. He had talked to two lawyers, but its not clear who he was talking to on the overheard call. They were still at Newton's dorm building when that occurred.

As another aside, the report says they found "numerous gaming consoles and another laptop" during the search of the room. Anything ever come of that? More stolen property? Room mate?

The bigger question is, WTF is Cam Newton doing with an Atty on retainer? He's a model citizen.
