An important part of the NCAA case, according to the NY Times article, is that the Tennessee NIL group (the Volunteer Club) used a private jet to fly Nico Iamaleava to Knoxville while he was being recruited.
The article states the Volunteer Club is closely linked to a marketing agency called Spyre Sports Group. The two entities share the same top officers and the same address in Knoxville. Which is gonna make it hard for Tennessee to prove there's no overlap between their recruiting efforts and their use of NIL funds.

Nico should be ineligible by the letter of the law and not start for Tennessee this season. It certainly puts them in a precarious spot when it comes to potential vacating future wins.
