Ok. Are you saying the statement that I suggested would offer an explanation of why Miller wasn’t charged is releasing all of their info or any info that would be damaging to their case?

They have to provide their evidence to the defense. There is no trial by surprise, especially in criminal cases.

Providing information about why someone is just a witness and not a defendant seems in bounds to me.
