This would only be similar to the Miles situation if Miles was actually in the process of committing a crime. He could have been, but right now we don't know that for sure.

Felony Murder Law Alabama

Miles can be charged under the felony murder statute of Alabama. The above example is from Indiana, but Alabama has the same law.
