re: CN ineligible -- PROOF!

i like the way this CBS guy is reporting.
quote:
The NCAA is scheduled in January to hear USC's appeal on the Reggie Bush case. The BCS is waiting for the presumed rejection of that appeal to vacate the Trojans' 2004 BCS title. Could the BCS be dealing with two cases at once? If Auburn wins the 2010 national championship, it too could be vacated if Newton is later found to have played while ineligible.

Enjoy it, Auburn, because Cam-gate ain't over

Party your behinds off. Burn the mother to the ground. T.P. the town if you want. Live 'til you Dye. War Cam Eagle and all that. Saturday might be all you have.

i think it is going to be extremely hard to prove that Cam had no knowledge of the scheme -- especially considering that it was his father who was representing him. maybe if it was like someone he didn't know. but his father?

the Denver Post is talking forfeit ( story ):

The NCAA normally works with glacial-like precision in its investigations, but anything is possible, including this: declaring Newton ineligible and forcing Auburn to forfeit every win it has starting with Saturday night.

the good news for LSU is that the NCAA zealously wants to avoid what happened with Reggie Bush and USC -- especially considering that it just occurred. you can bet they are just waiting to make an example out of someone to show that this sort of thing will not be tolerated. and the fact that the FBI is helping with the investigation shows that things will be dealt with ... swiftly.

I am a sinner. I have sin in my heart.
but I'm also an LSU Tiger!
and my team will soon be undefeated again when AU is forced to forfeit their win against us!

HERE is a great article entitled "The Cecil and Kenny Show - The Ever Twisting Saga of Cam Newton". a few quotes:
quote:
But for pollsters, if Auburn keeps winning, what do you do? If Newton was really paid this massive amount of cash by Auburn to go to school there, he and Auburn have no business staying ranked high enough to compete for a BCS title. If I am a voter, win or lose, I dump Auburn out of the Top 2 this week.
quote:
Duck and cover Auburn and Cam Newton, because it’s about to hit the fan.

I think timing may prevent that. To actually forfeit immediately, IMO its going to have to be proven rather swiftly that Auburn knew what was going on and shouldn't have played him.
how swiftly?

taken from the 2010-2011 NCAA D1 manual:
10.1 UNETHICAL CONDUCT
Unethical conduct by a prospective or enrolled student-athlete or a current or former institutional staff member (e.g., coach, professor, tutor, teaching assistant, student manager, student trainer) may include, but is not limited to, the following: (Revised: 1/10/90, 1/9/96, 2/22/01)
(c) Knowing involvement in offering or providing a prospective or an enrolled student-athlete an improper inducement or extra benefit or improper financial aid; (Revised: 1/9/96)
10.4 DISCIPLINARY ACTION [#]
Prospective or enrolled student-athletes found in violation of the provisions of this regulation shall be ineligible for further intercollegiate competition, subject to appeal to the Committee on Student-Athlete Reinstatement for restoration of eligibility. (See Bylaw 10.3.2 for sanctions of student-athletes involved in violations of Bylaw 10.3.)Institutional staff members found in violation of the provisions of this regulation shall be subject to disciplinary or corrective action as set forth in Bylaw 19.5.2.2 of the NCAA enforcement procedures, whether such violations occurred at the certifying institution or during the individual’s previous employment at another member institution.
CN stated that he was letting his father choose which school he would attend. so, CN chose to let Cecil represent him --in effect-- as an agent. so, it does not matter if CN knew of his father's actions or not because Cecil was acting FOR (on behalf of, as an agent for) CN. in the eyes of the NCAA, Cecil's actions become CN's actions. therefore, when Cecil asked for under-the-table money from MSU (as admitted), he effectively involved CN in a pay-4-play scheme which resulted in CN's immediate loss of college eligibility and ending CN's collegiate career.
on a personal note, good luck to Cam in the pro's. i'm sure he'll go number 1 and then onto millions. but this is college football.

re: LEGAL Questions:

here's a question:
how can the Newton's afford a lawyer if they could not afford the needed repairs to their church only a few months before?
lawyers cost over $200 an hour and usually require a retainer. something smells rotten in AU.

do you think respected news institutions check and double check their facts before running a news story? what you read is generally a glazed over version of the real story. the truth is probably worse.

So why is there no record of him going before the academic council? No record of even a case? Did he receive preferential treatment or something?
i read that he transferred to Blinn before the case went before the council. and i would assume the Heisman voters would judge you on your entire academic or collegiate career, but i don't know the exact answer. anyone?
does Cam Newton conduct himself with "integrity"?

taken from the official Heisman Trophy website:
here are the facts:
1 - Cam was cited three times for academic misconduct while at UF (story)
2 - he has been arrested for felony charges of burglary, larceny, and obstruction of justice (story)
3 - he has been cited over TEN times for driving violations including driving without a license twice and driving on a suspended license (story)
and in case you are unaware, integrity means:
i'm not claiming to have integrity, but i'm not the one being considered for the Heisman Trophy.

in reference to NCAA rules, would "Unethical Conduct" include the supposed missteps Cam made at Florida? i mean, do we really want this person as our Heisman trophy winner?
re: Is the "on behalf of" phrase even in the text of the actual rule?

HERE is the original BAMA thread that inspired the unverified rules quote. i cannot vouch for the link's legitimacy, but these are some promising quotes:
"The NCAA adjusted its rules definition at the end of 2009...even the intent to do pay for play deems you ineligible."
"NCAA made a statement when they said there could be serious ramifications if AU does play Cam and he is later deemed ineligible."
let's hope this is true.

i got that rules quote from another thread. it is HERE. didn't give a source.
i agree with e2drummer. this case is a new area for and is probably going to result in some new rules from the NCAA. on the bright side, Rule 12.3.1.2 makes explicit mention of "relatives or friends", and i bet that will be the spirit of any decision on the matter. the NCAA will not condone fathers obtaining agents to solicit for their sons. any new rules will reflect this.
on the dark side, i bet this takes at least a year or more to conclude. just look at the Reggie Bush case -- 4 years. and this is bad for LSU's title chances this year. sad.

re: CBS reporting the Cecil Newton admits to soliciting payments

i've been doing a lot of reading on this. right now, it seems the NCAA is aware that there was a clear rules violation when Cam's father obtained the services of an agent to solicit money on Cam's behalf, and they are not doing much about it. that would mean that they are either going to ...
1 - conduct a long investigation (like the Reggie Bush case, 4 years!)
2 - maybe discuss this when the rules/infractions committee meets again (in Dec?) and perhaps take some sort of action then.
for now, it looks like Cam will be eligible for at least the regular season ... will probably get the Heisman ... only to be declared ineligible at a later time and have it taken away and have wins vacated. WOW! i can't believe the NCAA is going to blow this so soon after the Reggie Bush scandal. THEY MUST BE PRETTY INEPT!

i would agree. even though there have been clear violations --a father getting an agent to solicit on behalf of his son, it seems as if the NCAA is looking the other way ... for now.
but i would bet that this is far from the end. new information will continue to surface --just as it has been-- which in turn will force the NCAA to get more involved.
