I believe the word you're looking for is "browserwrap". Look up the Zappos lawsuit from December 2012 for reference into what is actually legally enforceable under terms of service.

Since we don’t pay to be here, I think they can do whatever they want whether it’s in their terms of service or not, I really don’t think it’s a question of what they can’t do. I think it’s a question of what is right and what is fair and just.

Browserwrap refers to things not written into the ToS or added after the fact that the user never agreed to but the site says they did by agreeing to the initial terms of service/use.

If a magazine you can buy at any age has it, then its appropriate.
