It certainly isn't out of the realm. Aubie the mascot often eats under the Oaks, and the Tigerettes often frolic with recruits under the Oaks as well. They could have been harmed by the poison dispensed by Updyke. I have also heard Spirit used to get squirrels from the Oaks. It could have been disastrous indeed.

It's probably been mentioned already but I hope everyone realizes he did commit a "hate crime" for whatever that's worth.

I guess there will be a lot of discretion used in his sentencing that can set a precedence for such act if there's not one. A year in jail is not too harsh, IMO. This will stop people from vandalizing things that matter to a large population.
Well said. I don't think the signifigance of the trees should make a difference in the charges. It should absolutely make a difference at sentencing.
Why some people don't get this, I don't understand.

He's destroyed something that is irreplaceable. That should certainly be factored into the sentencing. He didn't just illegally poison trees, he poisoned trees that have significant meaning for a substantial group of people.
There's a difference. There's a difference between ripping up a piece of loose-leaf paper and ripping up the Composition Draft of the Declaration of Independence, even though both are inanimate. There's a difference in throwing paint on someone's fur coat and throwing paint on the Mona Lisa. There would be a difference between busting up the sidewalk in front of my house and busting up the handprints on the Walk of Champions.
When you destroy something that's irreplaceable and meaningful, it goes beyond simple vandalism and mischief. Add to that the fact that he put poisonous chemicals into the ground without knowing what the hell he was doing, and I'm all for the guy serving a couple of years in jail, along with fines, restitution, and not being allowed anywhere near college football.
Frick that guy. Seriously. And, honestly, frick anyone who says what he did "isn't that bad."
