I am not familiar with any court ruling in regard to the transfer portal the way it is now. There might be but assume if may be like NIL rulings that have so much gray area to work around to manipulate it.

Currently(DEC) there is a temporary order in place not allowing the NCAA to force a sit out if transferring. So pending a ruling that looks to not go in the favor of the NCAA.

The original guidance on NIL came out a few weeks after the supreme court ruling in 2021 that made NIL a thing. This was a "preliminary" policy, but it essentially matched what the final policy was, it just didn't have the exact wording.
The only real NIL rule is that you can't have pay to play, which was in the preliminary policy.
If there were new requirements in the NIL policy that was eventually finalized that weren't in the preliminary policy, it being retroactive might be an issue. But the reality is that's a red herring. The preliminary NIL requirements are the same as the finalized ones. That's why the member institutions of the NCAA had no issue witht hem being retroactive.
