Don't over think it. Miller is a witness and has given statements about his teammate (Miles). It is part of the criminal justice system, find the person least involved and have them testify against the others without the fear of prison. Deals like this are critical in getting convictions.

From a prosecutor’s standpoint, there’s some plausibility that it makes some sense to forego charging Miller if you think his testimony will bolster the case against the others.

From the University’s standpoint, they should make a decision independent of what the prosecutors’ strategical choices. It appears the University’s strategy is to say “no prosecution therefore no reason to punish or investigate further,” but we can all see how self-serving and unreasonable that position is.

Uhh… because that information has been public knowledge since about a day after the incident happened, and at the time the article was written - it had been testified about under oath. That’s how.
