B) Pothole was big and driver should have taken steps to avoid it

He could sue, but he'd have a hard time explaining the 3 dead bodies in the back of his murder van. He should just cut his losses

Isn't that always the problem though? You have a fresh selection of corpses in your murder van and that is when you run into the gaping chasm in the road. I know we have all been there.
