Correct, it’s easier to walk a DUI back then seek a charge later.

Fact is we don’t know if he was over the limit, under, totally shitface, high, whatever. It will all come out in the blood.

However, like most of these dudes he probably speed dialed his lawyer, got quick advice and prolonged that blood draw as long as possible.

And prosecutors will likely use retrograde extrapolation to show probable BAC at the time the accident occurred. There will be toxicology experts on both sides of this do all sorts of science-ing
