There is no way they can know who is unvaccinated. Someone simply saying they are vaccinated is good enough under Alabama law. They could never ever require them to provide proof. Actually, they can't even ask in the first place, so there should never be a situation where someone had to respond to such a thing.

Or, someone simply saying "I don't have to tell you that" and going back to class would be totally within their rights to do so.

The law you are referencing under subsection 3 states that the UA can adopt these policies but they can not require proof of immunization to attend the college. So yes they can not enforce it but at the same time they are not violating the law either.

But the law does not stop them from requiring testing if an outbreak or someone living with someone is positive. The law also does not prevent them from making the student return home for their quarantine or provide another location for them to quarantine on campus if unable to return home. It also does not prevent a professor from saying sorry but you missed to much class. These would all apply to both unvaccinated and vaccinated students.

Their failure in their statement/plan does not break the law but it does specifically target those who are not vaccinated. They could have simply left out the unvaccinated student portion of the statement and made it apply to the entire student body, which it does and should.
