This makes no sense. Look at the rule for targeting. Does he lead with the crown of his helmet with forcible contact? Check. Does he lower his helmet prior to attack? Check.

I don't know how anyone could even argue it. If you don't like rule, that's fine, but by definition, that's targeting.
