It is mentioned in their response as part of their defense. They have to prove it to the COI. It's nowhere in any document from the NCAA.

And it's probably just a made up scenario to rile up the fans into thinking they are conspired against. It will not even be brought up by OM at the hearing cuz it's fiction.
