That's where I think you're wrong. You face legal consequences for posts like that if they're untrue and can be sued even if they are 100 percent true. Most people consider hearsay indirect/3rd party. IOW, the murderer told me she was beaten and that's why she did it OR the victim told me she was raped at 3.00 AM Sunday. But again, once it's permitted by the courts it's not hearsay. In this case, a public social media post can (and they have been in the past) treated the same as direct evidence/admissions.

Documents/the written word (even social media) is quite often admitted into evidence.
