You are right. It isn't impossible, I'd say just highly improbable. The statement he made, put his decision in a much worse light then it needed to be. I wonder if the arresting officer did something wrong and instead of throwing him under the bus and exposing the department and his office to blowback, he hastily throw together some half assed statement about sweat and A/C.

Agreed that is what it seems like. Seems like a 100% honest statement would have been "we didn't collect evidence correctly and it is questionable as to whether the search was even legal. Therefore we can't make a case at this time."
