Lots of defendants choose (or, rather, are told by their lawyers to choose) not to take the stand and still get off. It's a bit more complicated than that.

Yes I know, and I figured someone would say that in response, but the general thought process is pretty standard. The vast majority of innocent people want to tell you their innocent. That proclamation doesn't mean they are, and their silence doesn't guarantee their guilty, but people can still infer something from that silence.
With respect to the Ole Miss allegations, I see absolutely no reason you'd let it get this far if your endgame is going to be to recant the comments. They're going to take a different approach IMO, and anything short of a recant is really bad news for Ole Miss.
I also want to be clear that "bad news" for Ole Miss doesn't mean crazy sanctions, because the NCAA has no consistency, but there is no doubt it is bad news from a perception standpoint and in the court of public opinion.

At this point, I think the best thing for Tunsil is to remain quiet. Let other stories begin to over-take this one (if they can), but don't add any more fuel to the fire.
Plus, there's nothing the NCAA can really do to Tunsil, from here on, it's about his relationship with the Dolphins and how he performs there.
For Ole Miss however, I would think they would have wanted to get some form of statement out quickly, because the longer it takes to respond, the more it looks like they are trying to continue a coverup.
Maybe Random can shine some light here, but what is interesting are the conflicts of interest at play.
1) Tunsil and Freeze have the same agent
2) Tunsil is represented by an Ole Miss lawyer in the civil "case" that his money-grubbing stepdad just filed

If that was actually said to the jury, that's grounds for a mistrial, just saying.
