So...no one else is going to comment on the fact that spd waited 45 minutes to give him a breathalyzer and then another 30 for the second one? And neither of which happen to work.

Have you ever heard of someone being given a breathalyzer a full 45 minutes after the stop?
I was given mine within 5 minutes(don't worry...I was well lower than the limit)
And the only thing that an "insufficient sample" on a breathalyzer could means is that he couldn't blow hard enough(insert egg bowl joke). Are you telling me that an elite athlete doesn't have the lung capacity to blow enough into a breathalyzer?
