The First amendment calls for freedom to observe a religion but does not allow for a state sponsored religion
People use Jefferson wall of seperation as defense of no religion in the government.
Since our court system is based on precedence once a judge advocated for removal all interpretations have to be based off that, unless a procedural flaw was found.

You don't think that observing a religion within government would be respecting an establishment of religion?
quote:
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.
