Wow. So it is at cops discretion, then? That surprises me. I wonder how that holds up in court? It doesn't make sense for a cop to say someone is drunk because...well...I THOUGHT he was drunk. I'm sure if it wasn't such a minor charge it would go under challenge and they would have to set a limit much like driving. At least, you would think that would happen.

Well, I saw Denzel Saturday night walking around the Square, and in this case it was well deserved 
BUT, have had friends threatened with it as they walk out of bars, as well as some arrested for much less than Nkemdiche.
