Yeah, that attorney did his client no favors with his press conference and comments. Laughing about it, saying the only person who would think his client did anything wrong would be his (Winston's) girlfriend. Making the accuser out to be a lying slut out to make his client look bad - when she didn't even know who he was until sometime the next month. He's the kind of lawyer that gives them all bad reps.

To the few idiots who believe drunk people can legally consent to sex, you are so wrong. I think the law can be silly, but LEGALLY, a drunk person cannot consent to sex. You don't have to like, or even believe it, but that doesn't stop it from being the truth.

Additionally, the only issue I have is that her blood alcohol content wasn't tested when she was "drunk" that night. You can't point to what the police report said and assume that .04 was how drunk she was, seeing as she wasn't tested until much later, when she was already sobered up.

I honestly don't understand how he's gotten away with acting like that. Knoxville's a pretty mild mannered place but I think the city and the campus would explode if he behaved like that.

Especially when the documents that were released reveal some very disturbing tidbits:

The documents also show the state attorney tried to find the cab driver who drove Winston and his accuser from Pot Belly's to Winston's Chapel Drive apartment that night, but had no luck.

The documents also show one of Winston's friends recorded a portion of the sexual encounter on his cell phone that night, but later deleted it and discarded the phone.

Text messages retrieved from the accuser's phone the night of December 7 show a woman in clear distress.

A text to a friend at 11:49 the next morning says "I have to talk to you. I spent all night in the hospital."

A text four minutes later says "I got raped. I don't want to text about it. My parents are here."

When the friend asked how they got there so fast, the woman texted back "My dad went like 100 the whole way here at 4 in the morning."

The state attorney announced Thursday that FSU quarterback Jameis Winston would not face any criminal charges in the case and deemed it case closed.

Winston's attorney called it "a one night stand" Thursday and maintains it was a consensual encounter.


Now just how in the hell did the friend who took video know to "lose" that phone? That it was recorded and the entire phone completely discarded tells me more than enough about what happened. Nashville PD went all the way to California to investigate and recovered the images recorded on phones in the Vandy rape case. One of those charged with tampering was Vandenburg's friend in California. But TPD can't follow up for months when it was reported that night? Well unless following up means tipping off FSU and allowing Jansen to work his 'magic.'

Is Tallahassee so damned corrupt that this is how it went down?

Witness: "Yeah detective I recorded my buddy having consensual sex and so when his lawyer told me the girl said she was raped and said y'all were coming to speak with me, I knew it would prove his innocence but damned if I didn't drop it in the toilet and wind up having to throw it away a few months before you got here!"

Detective: "Well I guess that's all we can do. Thanks for reassuring us it was all consensual. I figured it was but you know we have to check these things out. I'm sorry I couldn't get out here before now. I hope Jameis isn't too mad at you for losing the phone. Oh btw, could autograph this football for me? I'm a big FSU fan."
