They won't be able to.

The NCAA will go away simply because the courts would take away their reason for existing. The SEC couldn't step in and regulate if the courts say regulation is not allowed.

What we'll have is no rule for the conferences or for college football, but each state will have an individual slate of laws for NIL. Some states have no laws, and schools there will be able to whatever they want, including giving a player money tied directly to coming to a school.

Some schools will have state rules that prevent them from doing that, so you can have a scenario where Alabama (a state that has NO NIL laws on the books) can do whatever they want to in terms of paying players while Tennessee (which has NIL laws) is unable to do so. The courts will make it so that there is no overriding NIL rule, only the state rules apply. This will create an uneven playing field which will benefit schools in states with no NIL laws on the books the most (like Alabama).

I don't know if Tennessee realizes they're setting Alabama up for more success with their lawsuit.
