I'm not sure that was the flag of the confederacy. I think but not sure is that the flag of the armies of Northern Virginia was the flag of the confederacy.

I read somewhere that while the confederate flag was indeed for bad intentions, Lee wanted to use it to differentiate flags from the North and the South as many flags were similar. I could be wrong.
