They wouldn’t have standing as long as they were free to transfer.

The punishment wouldn’t be for NIL, it would be for using NIL as an inducement to sign.

They could easily have standing by arguing that even with the opportunity to transfer, they’d employment opportunities were hindered. Imagine a senior starting QB plausibly arguing that the necessity of transfer hurts his future employment opportunities.
