Not sure how the federal government could regulate adults signing contracts for their name and likeness.
NCAA would potentially be violating state laws if it tries to step in and says a star QB can only make $X.
We may not like it, but these kids have a valuable asset (their name and likeness), and they are allowed to profit off of that. Sucks for the competitiveness of the sport, but CFB has never been a level playing field.
In reality, setting up a strong NIL structure is now probably the #1 thing programs need to be targeting.

If they are not good enough to market NIL money, why are we offering them a scholly in the first place? Not being a smartarse, but it is a fair question. This has changed the landscape IN BOTH DIRECTIONS. Saban kicking a five star lineman and a high four star receiver to the curb and trading them in with upgrades will be the standard going forward. In other words, you wanna get paid you better perform.
Lets understand NIL, your contract can be your likeness showing up to sign your check after you sign your loi, they dont have to "do" anything, sponsor anything, have their likeness used, it can simply be a personal services contract.

There are a myriad of avenues the fed/state govt could move in to regulate it. The state budgets over 180 million annually for Auburn and feds kick in over 40 million in grants, gives them quite the leverage. But will probably be the NCAA stopping some schools like A&M from literally buying championships, some sort of salary cap at some point.
This has never been more true. The same agency firm negotiating for Saban is now negotiating for Bryce Young I believe. These super agents/firms, see a huge new market to exploit and we have to have a negotiating team/accountants to budget by position/ class, existing players and renegotiation, thats a whole dept of people outside of the school.
Within the school we had better restructure recruiting and have a whole dept dedicated specifically for the portal, this year over 2500 kids hit the portal, and these arent potential high school kids, these are proven performers with a lot higher hit rate on success, and they deem the attention.
Gone are the days of "he is a good recruiting coach" its "show me the money".
