Relax. This is all for leverage. On both sides. Neither wants to live with 6 years of monthly payments. There will be a settlement. This will not be tried.

Well, it depends. LSU told BK's reps yesterday, according to the lawsuit, that they had not yet formally terminated BK. That could be construed as an attempt to avoid the buyout.

It was done to increase BK's leverage. Whether or not it was necessary depends on the status of the negotiations. Starting now, BK has to look for a job. If he is ready to retire then time is of the essence. So upping the leverage may be prudent for BK and his team.
And they will settle. It is not in BK's best interests to take a month by month buyout and risk further litigation over whether he is making good faith efforts to find a job.

His lawyers filed the suit for leverage. In the end, BK probably will take a lump sum settlement, just not the sub $30m that LSU wanted.
Anything that happens between BK and LSU from here on out is for leverage, pure and simple. Trying to publicly give LSU a black eye is part of that.
Given that the contract requires BK to make good faith efforts to find a new job commensurate with his skill the level the only real issue before the judge is whether he was fired with or without case. With cause firing reasons are set forth in the contract.
If this case ends, and BK wins, LSU can file suit a year or two later and seek a reduction in payments because of BK's lack of good faith in seeking a new job. Given that, and the length of the buyout, it will probably settle sometime before the summer.
