Oh, you can be certain that mitigating damages is exactly what they're doing. If you think the firm advising Tennessee is tone deaf, then this must be your first rodeo. They are probably the foremost firm in the country both at fighting the NCAA and using the NCAA to leverage firing a coach for cause, and advising universities on whether to fight the NCAA or the coach.. The Tennessee administration looked hard at two more years under Pruitt and realized what was coming was no worse than probation, so they elected to start over now instead of 2022 or 2023 and saved millions in the process.
