As far as the appeal goes, Ole Miss brings several issues to light as to how the investigation was handled so poorly by those involved. The NCAA has also acknowledged some of those errors.
The Rebel Rags lawsuit may be what finally unveils just how openly biased the NCAA was toward Ole Miss. before and during their investigation. It may also uncover why they were so biased.
It is clear in the NCAA over reached when claiming that infractions that occurred nearly 20 years again, so a pattern of habitual cheating. (Ole Miss had the least violations in the SEC during the that same period) So any team hit with violations in the SEC should get hit with the LOIC penalty.
The fact that the NCAA believes the stories of the players and Tunsil's step dad were "similar" enough to warrant another year of a bowl ban and loss of SEC money is another miss step on their part. There was just as much evidence to show what they claim could not have happened the way it was told. Along with the testimony of those who knew the players that were contrary to what the player's claimed.
Lastly, Mullen's part in this whole affair should be pointed out. He knew before the rule was ever changed to interview his players. He even told his players they were going to be interviewed more than 4 months prior.
I believe the RR lawsuit, which now includes Mullen, has potential to reveal just this investigation was not just poorly handled but started out with an agenda and more than the ncaa was involved with bringing these predetermined results about.
Enough information could come from that lawsuit to give Ole Miss cause to bring a lawsuit against the NCAA.
