Even if they did: He. Was. With. Al-Qaeda. His dad was a major figure in Al-Qaeda. You pick up a weapon or give aid to an enemy while simultaneously in an active conflict zone...what happens?

The matter of their identification isn't pertinent.

The difference between us is that if you had evidence to the contrary, I'd believe you. You'll do everything within your power to refuse to believe that you may be misinformed.

It is only war when war is declared, otherwise the legal system is the method de jure and de facto for crimes, even against the state.

warfare (usually uncountable, plural warfares)
The waging of war or armed conflict against an enemy [quotations ?]
Military operations of some particular kind e.g. guerrilla warfare

You'll want to read the second entry very closely.

You're right, Yemen loves it when terrorists blow up their hospitals. Pakistan hates all of the money we send them.

Yeah, people who sit there and watch an airstrike in an area with known terrorists elements are completely oblivious to what might happen.

Giving aid to enemy combatants (while simultaneously knowing they've been targeted) is a tacit acknowledgment that the person in question understands that they may be killed as well.

Ever been taught how to respond to an explosion? I suggest you look it up.
