Sure, which means he's going to have to hear some compelling legal authority and/or additional evidence to change his mind. Very rarely are reserved issues like this later overturned. Kind of like appeals. Everyone has a right to appeal decisions made by the court. That doesn't mean there is a likelihood of success.
