Tell that to Kristian Saucier. You can find him waiting to see which federal prison he will call home for roughly the next decade. He took photos of his sub with his phone then later deleted them and lied about it. Sound familiar? Unlike Clinton, his photos were not on the Internet and he never made any effort nor was we ever suspected of wanting to turn them over to anyone else.

She wasn't prosecuted because she is Hillary Clinton, who was Secretary of State at the time of her actions. Her lead witness would have been the POTUS, who would have testified he knew of the private account.

It was an unwinnable case. At best, you were looking at a hung jury. Prosecutors decline cases because they can't win them all the time. It is an uncomfortable but valid reason and was probably the correct decision here but when the FBI director said others would not have been prosecuted he blatantly lied because it happened as recently as last year.

But, unlike Clinton, Saucier did have real top secret information on his phone. Makes one wonder what was on his laptop that he smashed to pieces before the FBI could get it.
