These are phone records. It does not matter whether they give them permission to get them or not. The records would only be admissible in court against the 2 defendants if you have someone from the phone company testify. That is why you do a subpoena for them. It does not mean that Mauger & Langley they did not give their permission...

You have to prove who the phones belonged to by using the phone company records & they have to come from a phone company representative. It would be hearsay if the officers just stated that the numbers were on the defendants phones. The phone company can testify and it is not hearsay...

The phone company won't release the records to the PD without a warrant or subpoena, even with the consent of Langley and Mauger...

There is only a problem if the police find evidence that they were in communication with the defendants. Which both have denied & since they both reported the suspicious activity on their accounts within days of the deposits & withdrawals, there's no real reason to doubt their statements...
