I meant the case and article really isn't about the 10% rule as much as Texas's use of race as admission criteria. Unless something changed since 2012 we don't do that:

My understanding is race can be used as a selection factor, but quotas are forbidden - sounds like it could be abused, though.

yeah, I didn't read the article when I posted that only his headline and your response and jumped to conclusions. Our discretionary acceptance policy is not the same. However the fact that it is discretionary means it could change and this ruling paves the way for any state institution to use race.
