They need a reason to punish though.

Unless a GM came out and openly said "we didn't draft Sam bc he was gay." how could they prove what the intent was?

Wouldnt matter, the league isnt bound by public accommodation laws. The only thing that could happen is the league could fine that franchise but with no rules about gay discrimination Im not sure how they'd justify it.
