If it is carried to trial, just saying he was emotionally distressed isn't enough. A physical manifestation of the effects of the emotional distress must be proven.
"It hurt my feelings when the meanies on the internet made fun of me" isn't going to cut it.
"I lost hair, weight, and spent all day vomiting" is some good shite though..

and the crime was sexual in nature. its a bit different than a normal case because the guy was basically raped. also why the teabagger should carry the sex offender tag
