Damn you are thick.

You just quoted that a fumble cannot occur during the act of passing. The toss over the head is considered a pass and get this: a backward pass even. So since we have established that the ball is not a fumble because it occurred in the act of passing and is not an incomplete because it was a backward pass, that leaves a "loose ball", which isn't subjected to the exceptions outlined in te OP
