Absolutely, Miller’s attorney should use this however they may, but common sense tells me Miller likely saw that text before the gun was retrieved in his car (perhaps after he parked, but maybe not). But even if we all accepted that as fact, I still don’t think this is as bad for Miller as his put-him-in-jail lemmings (who appear to be hopelessly brainwashed)
it's relevant because we know that the police and the da had access to millers phone, I believe I saw somewhere that he surrendered it to them to have the contents dumped. That would allow them to see if he did in fact view the text before arriving and if so exactly when that happened relative to the other events. But I do get your point. It's a long way from going to get your friend who left his stuff in your car, which includes his what I assume is a legally owned gun because I didn't see any illegal possession charges for miles, even if he know the gun was there, to assuming somehow that your friend was going to give his gun to his other crazy friend who then goes and gets in a shootout. There is no intent even if Miller did read the text and knew the gun was there. As was stated before, the fact that he just sat there in his car right in front of where the shootout happened with another unnamed (presumably female) passenger implied he didn't know it was going to happen. If he knew it was going down he would have driven off before the shooting instead of nearly getting shot himself. Instead he was waiting there for miles who it seems had moved over the other side of the street possibly to retrieve his girlfriend who was participating somehow in the girl fight that was going on in the alley.
