The difference is the facts. 
If he was on tape actually making an offer to anyone that had the authority to accept the offer all of this would have been over a long time ago.

It's not a criminal case, but believe me when I say that a confession is all that is needed. And it doesn't have to be a confession to an authority or even recorded.

The NCAA doesn’t know any more than we do as far as that is concerned. They have the tapes offered at the Dawkins trial. These have been around since 2017. If they had more than that, we’d know about it by now. But I do eagerly await the next Wade news drop around tournament time next year. It’s become a yearly tradition

None of that even matters. If Wade was caught on tape actually making an offer to anyone there would be no point in trying to fight it. It would be over with. The fact is that he was not making an offer to anyone at all. Will that matter in the end? I have no clue.
I do know that he wasn't caught on tape making an offer to someone. He wasn't caught on tape cheating. He wasn't caught on tape paying players. He wasn't caught on tape doing a lot of things that people say that he was doing.
