Is it really that hard to tell the difference in drunkenly not driving a moving car and sleeping in a car that's not one moving?

One is a weapon that can kill others and ones self. One is a stationary object with a person asleep in it.

And yes, if you decided driving drunk was a bad idea and parked in a lot to sleep it off thatd be a very good decision that is light years better than continuing to operate a moving vehicle while intoxicated.

I honestly don't have much of an issue with this one. I'm glad he wasn't driving. How old is Hand?

I mean being in that situation is stupid, but making that decision (assuming he coherently made it) is 10x better than just trying to sneak home in your car.

mean he could have intended to drive but passed out before. Also, how is it a foregone conclusion that he wasn't drunk driving before he parked and passed out?

No trolling here, just haven't seen this discussed much.

I've gotten drunk in the summer, at a place to far to get a cab ride, and ran my engine to sleep a couple hours with AC. It's illegal. But when it's still 85-90 after midnight, and don't want to drive drunk, its still the responsible thing to do.

You think he passed out between the time he cranked the car and he went to put it in gear? That usually takes all of about three seconds, so I'd guess he made the decision to not drive because he was too impaired
No, he passed out. You don't "decide" to start the car and take a nap. You could move and put the car in gear, you could run out your gas and battery while you slept, you could have a small exhaust leak and die, any number of bad things can happen. ONLY good thing would be AC.

Regarding the amount of time it took- how many times has a guy got wasted, got naked and hopped in bed with a girl, and fell asleep on her? Stuff like that happens a lot, because it really doesn't take long to go under, especially once you get comfortable.

There was once an LSU basketball player a couple decades ago, passed out at a red light right outside campus (by the Chimes).

PLENTY of people do. Hell I know a guy that did it last weekend. Happened all the time in college.
