Haven't read the rest, but your second assertion is correct (Which is why crimes of passion, if convicted as such, have a different set of punishments).
Your first assertion, is slightly correct. They do believe they are going to get away with it. But they also know that if they don't, the punishment isn't all that bad. Would they attempt a murder if they knew for a fact they would be killed if caught? Are there cases of 'excusable crime'?
