By the way, you and I disagree on what sexually explicit means.

According to lectlaw.com

SEXUALLY EXPLICIT CONDUCT

So the only thing that can come close is just the showing of the genitals in a lascivious way. There is nothing to suggest she wasn't wearing underwear with the shirt. I will agree with you that there are some unknowns but it doesn't look good for them either way. Although if rape isn't a charge will be a lot better.

They aren't the same. One is based on an action. The other refers to media (such as photos, videos, & writing).

You're trying to argue that if they put a some titties in a video game that it wouldn't receive a sexually explicit content label on it. Or if Kayne West came out with a new music video showing some titties there would be no sexually explicit content warning on it.

No need for parental overview for little Johnny on picking up the new Xbox One game. It only shows some titties in it.
