I think the NCAA is pretty useless, but in this matter, they're very much hamstrung due to state laws (and the SCOTUS saying players can make money). The NCAA can only provide "guidance" while Congress takes its time to set up regulations (if they ever do).

Until then, each state can set their own NIL laws. The only thing the NCAA can dictate is that NIL offers do not violate pay-for-play policies and that the student athletes don't receive financial incentives to sign with or remain at a program.

It's that last part that is a problem right now, as it seems some schools are using NIL as a recruiting tool when NIL is supposed to apply to NCAA-governed student athletes (those already enrolled at universities).
