Actually, it does work that way. As per ESPN, the NCAA can't use last night's presser as evidence under their own rules. They can only use statements given directly to them.
They can ask for the personal phone of the staff member and any other pertinent records. If Tunsil won't say that again directly to them, they have to find evidence of those messages from someone over which they have jurisdiction.

Mizzou, I do find this picture and the pot mask video to be especially ironic in that, as he sits back, there is clearly an old-school Ole Miss flag on the wall above hiis right shoulder with Col. Reb and what I have to assume the words "Rebel Pride" on it (although all that can bee seen is "Pride") when the school and athletic program have worked to such extreme measures to divorce themselves from those images in every manner possible.
